Legal framework of occupational accident and disease prevention and compensation Abstract This project will produce a document describing the legal framework for the prevention and compensation of occupational accidents and diseases. The document will summarize current law, and develop a strategy for systemic analysis and critical review. In particular, it will compare some of the fundamental aspects of the current legal regime with analogous North American legislative principles, and highlight the sources and original aspects of the Québec system.The fundamental concepts to be covered include, but are not limited to, the historical background and evolution of the Québec regime, the impact of the Free Trade Agreement and of the GATT, the rights and responsibilities of the parties, the concept of occupational injury, and available legal recourses.
